Prior to this, the Buyer agrees to take reasonable care to prevent the accidental breeding of or by this cat. The Buyer must provide a Veterinary Certificate of Spay or Neuter once the procedure is done. Once the spay/ neuter certificate is received the Seller will provide all necessary litter registration documents for the registration of the cat in TICA (The International Cat Association). The cost of such registration is the responsibility of the Buyer. In the event that the cat is not spayed/ neutered by one year of age, as stipulated in this contract, the Seller reserves the right to demand immediate return of the cat. At the SELLERS discretion, and provided that the cat does not display any faults that would preclude it’s use as a breeder, an alternative agreement may be entered into for the purchase of the animal as a whole cat. If the Buyer does not wish to alter this cat, and if the Seller agrees that the cat is of breeding quality, the Seller may provide the necessary documents for the registration of the animal as a whole cat in TICA, for an additional cost of ________________________________________
BREEDER: If the Cat is purchased for breeding purposes, the Seller will provide all necessary documentation for registration of the animal as a whole cat in TICA, the cost of registration is the responsibility of the Buyer. The Buyer further agrees that:
1. This cat, nor any of its offspring will be used in any non-domestic or wild x domestic breeding programs.
2. This cat and any of his/her offspring will only be used in Oriental breeding programs with cats of allowable outcross breeds, such as Balinese, Oriental Longhair, Oriental Shorthair or Siamese
3. Cats sold as breeders are for use within the Buyers own breeding program only. It is recognised by both parties that a queen may be sent outside for breeding, but she will be returned in a timely manner and the kittens shall be born and under the direct care and ownership of the original Buyer.
4. Any kittens sold, co-owned, leased, given as a gift, or transferred in any way, must be transferred with a written contract such as this one. The sales contract for all kittens sold as Breeder or Show quality (without a spay/ neuter agreement) must contain all original clauses of this contact, to assure that responsible and reputable breeding will continue with cats of this lineage.
5. The Buyer will follow the going price for Oriental/ Siamese type cats when selling cats or kittens bred from this cat and will not sell to pet stores, animal brokers, kitten mills or other such wholesale or retail agencies.
6. The fertility of this Cat is guaranteed. If a female cat has not conceived within 2 years of the purchase date, after being bred to a proven male on at least two occasions. Or, in the case of a male cat, if he is unable to successfully breed a proven queen within two years of the purchase date, and has had at least two opportunities with two different proven queens, the Seller will, within a twelve month period, replace the above breeding cat with one of comparable value. Choice of replacement cat is at the discretion of the Seller. All transportation and registration costs are the responsibility of the Buyer. It is understood that failure to comply with any provision of this agreement will be considered a breech of contact. The seller retains an interest in the kitten/cat for purposes of enforcing this agreement and to ensure the long term well being of the cat. The Seller may enforce that interest without judicial intervention. The buyer will be liable for any court costs and related charges including attorney's fees resulting from the Seller enforcing the terms of this contract. This agreement is the entire agreement between the parties. In signing this document, the Buyer acknowledges that he/she has read, fully understands, and agrees to all of the terms and conditions of the above sale.
